1. Provider and Scope
These Terms apply to all use of the Platform MyComicBook.com and to all contracts concluded through it.
By using the Platform, the User fully accepts these Terms.
2. Service Description
The Platform enables Users to create personalized comic books generated automatically by artificial intelligence (AI), based on User-provided information (e.g., images, names, descriptions).
Key features:
- The content (text, images, storyline, character visuals) is generated fully automatically.
- The Provider does not manually edit, verify, or quality-check the output.
3. User Content Responsibility & Prohibited Content
The User confirms that all materials they upload (such as photos, names, descriptions):
- are lawful and do not violate any third-party rights (including copyright, trademarks, personal likeness, and privacy rights), and
- do not contain or promote any of the following:
- glorification of violence or threats of violence,
- pornographic, sexual, or sexualized content,
- any depiction of minors in sexual or inappropriate contexts,
- hate speech, discrimination, extremism, or political propaganda,
- encouragement of self-harm, drug abuse, or unlawful acts.
The User is fully responsible for the legality of their uploaded content and agrees to indemnify and hold the Provider harmless from any third-party claims arising from such content.
4. AI Output Disclaimer & No Warranty
The User acknowledges and accepts that:
- AI-generated output may vary in style, proportions, storytelling, and visual consistency.
- Unexpected, imperfect, stylized, abstract, or incomplete results are inherent to AI systems.
- The User has no claim to any specific artistic or visual outcome.
- The output is provided "as is", without any warranty, to the maximum extent permitted by law.
5. License and Usage Rights
The User receives a non-exclusive, non-transferable license to use the purchased comic for personal, private use only.
Commercial use is prohibited, unless expressly agreed in writing.
The Provider may use anonymized versions of generated works for portfolio and marketing purposes. The User may object to this in writing at any time.
6. Pricing, Payment, Refunds
Prices are shown in EUR/CHF including VAT where applicable.
Important: Because each product is custom-made and individually generated, the User expressly agrees:
- No right of withdrawal
- No refunds
- No returns or exchanges
Exception: Manufacturing defects in printed books produced by third-party print services. In such cases, the claim must be submitted directly to the printing provider, in accordance with their policies.
7. Limitation of Liability
To the fullest extent permitted by law:
- The Provider is not liable for any damages, indirect damages, or loss of profit.
- The total liability shall not exceed the amount paid for the respective order.
- The Provider is not responsible for third-party services (AI providers, payment processors, print suppliers, hosting providers).
8. Data Protection
Personal data is processed in accordance with the Swiss Data Protection Act (revDSG) and, where applicable, the EU GDPR.

9. Governing Law and Jurisdiction
These Terms are governed exclusively by Swiss law, excluding conflict-of-law rules and the CISG.
Exclusive place of jurisdiction: Zurich, Switzerland.
10. Changes to the Terms
The Provider may amend these Terms at any time. The version published on the Platform applies.
By generating a comic, you confirm that you have read, understood, and fully accepted these Terms.
